The clamp everybody forgets
A vented gas log set requires the damper to be permanently fixed part- open so combustion products cannot spill into the room. Installers do that with a clamp, and a decade later nobody remembers it is there.
It is correct for the appliance. It is also a permanent opening in the building envelope, and in Texas the cost lands on cooling rather than heating — conditioned air going up the flue through a long hot summer.
Check the clamp is still present
A clamp removed by a previous owner, or by someone sweeping the chimney, leaves the damper able to close. On a vented gas set that is dangerous.
You cannot fit a top-sealing damper over one
While a vented gas appliance is in place, the flue has to stay open. A top-mount damper is only an option on a wood-burning or genuinely unused fireplace.
Throat dampers on wood and unused fireplaces
Where the fireplace burns wood or nothing at all, the damper should seal. The cast or pressed plate most houses have is metal on metal and was designed to close rather than to seal, and decades of soot and heat make it worse.
Repair before replacement
A seized damper is often just fouled. Cleaning the seat and pivot and freeing the mechanism restores it.
Top-sealing is the better upgrade
A top-mount damper closes at the crown with a silicone gasket, seals properly, keeps the whole flue dry and doubles as a rain cap.

How do I know if mine seals?
Look up into the throat with a light. It should sit flat when closed. A draft with it shut means it is not sealing — or that it is clamped open deliberately.
Ours is clamped open. Is that wrong?
Not if you have a vented gas log set — it is required. It does mean the opening is permanent.
Is a top-mount worth it?
On a wood-burning or unused fireplace, yes. Not an option while a vented gas appliance is fitted.
Mine is rusted solid.
Often freeable by cleaning the seat and pivot. A cracked or warped plate is the point to replace.
